These Terms are a legal agreement between you and SurterreTube.com (“SurterreTube,” “we,” “us,” or “our”). By accessing or using our website or services (the “Services”), you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility & Accounts

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Services. You are responsible for the activity that occurs under your account and for keeping your login credentials secure. Administrative user accounts are provisioned separately and may have additional obligations.

2. Use of the Services

You may use the Services to watch live streams, participate in chat and reactions, and—if authorized—create and publish live streams and video-on-demand content (“Content”). You agree not to:

• Upload, stream, or share unlawful, infringing, harassing, hateful, or otherwise objectionable content;
• Violate the privacy or publicity rights of others (including recording individuals without consent where required by law);
• Interfere with or disrupt the Services or attempt to bypass security or access controls;
• Use the Services for spam, scams, malware, or other abusive behavior.

3. Your Content & Licenses

You retain any ownership rights you have in your Content. By submitting or streaming Content through the Services, you grant SurterreTube a non-exclusive, worldwide, royalty-free license to host, store, transmit, display, and create derivatives (e.g., automatic VODs or thumbnails) solely to operate, improve, and provide the Services.

You represent and warrant that you have all rights needed for the Content you provide, and that your Content does not infringe any third-party rights or laws.

4. Copyright & DMCA

We respect intellectual property rights. If you believe your copyrighted work has been used in a way that constitutes infringement, please email helpdesk@surterreproperties.com with:

• Your contact information;
• Identification of the copyrighted work and the material claimed to be infringing;
• A statement of good-faith belief and an attestation that the information is accurate and you are authorized to act.

5. Payments (If Applicable)

If you purchase any paid features, billing is handled by third-party processors. By submitting a payment, you authorize charges to your selected payment method. Fees are non-refundable unless required by law or explicitly stated otherwise.

6. Privacy

Our Privacy Policy explains how we collect and use information. By using the Services, you consent to the practices described there.

7. Termination

We may suspend or terminate access to the Services at any time, including for breach of these Terms, suspected abuse, legal risk, or operational reasons. You may stop using the Services at any time. Certain provisions survive termination (e.g., Sections 3, 8–12).

8. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted or error-free operation or that Content will be preserved.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SURTERRETUBE AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNT PAID BY YOU TO US (IF ANY) IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY.

10. Indemnification

You will indemnify and hold harmless SurterreTube and its affiliates from any claims, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your Content, or your violation of these Terms or applicable law.

11. Changes to the Services or Terms

We may update these Terms from time to time. We will post the updated Terms with a new “Last Updated” date. Your continued use of the Services after changes constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. The exclusive venue for disputes is the state or federal courts located in Orange County, California, and you consent to their jurisdiction.
